These Terms of Use ("Terms") govern your access to and use of PIF Perfect ("the Service"), owned by Moderate Genius Company and licensed to Moderate Genius Foundation ("we," "us," or "our"), including any subsidiaries, contractors, and authorized partners. By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you may not use the platform.

1. Account Registration

You must provide accurate, complete, and up-to-date information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity associated with your account.

2. License and Ownership

You are granted a limited, non-exclusive, non-transferable license to use the PIF Perfect platform solely for your business or internal organizational use. All content, software, analytics, dashboards, and intellectual property remain the sole property of Moderate Genius Company and its licensors.

3. Acceptable Use

You agree not to:

• Impersonate others or misrepresent your affiliation
• Use the platform to engage in illegal, abusive, or unethical behavior
• Access data or features you are not authorized to view
• Reverse-engineer, duplicate, or tamper with the software

4. Support and Data Access

Authorized personnel from Moderate Genius Foundation, its contractors, and its partners may access user accounts and data to provide technical support, onboarding, feature optimization, and performance insights. This access is limited to service delivery, user assistance, and compliance monitoring.

5. AI-Powered Features

The platform may analyze your data using automated systems or artificial intelligence (AI) to generate insights, performance alerts, strategic recommendations, or trend detection. These features are designed to benefit your company and are only visible to authorized users within your organization (e.g., managers or owners).

We may process both anonymized and identifiable data to deliver these features. If third-party AI processors (e.g., OpenAI) are used, data transfer will be minimal and compliant with all relevant privacy laws.

6. Marketing and Communications

By opting in, you may receive marketing emails or product updates. You may withdraw this consent at any time by following the unsubscribe instructions in any email or by contacting support.

7. Termination and Suspension

We reserve the right to suspend or terminate your access to the platform at any time, with or without notice, if you breach these Terms, fail to pay any applicable fees, or misuse the platform.

You may request account deletion by contacting support. Upon deletion, your profile will be anonymized, but your activity and performance data will remain associated with your organization's historical records to maintain reporting accuracy.

8. Data and Privacy

By using PIF Perfect, you agree to the collection and processing of your personal data as described in our Privacy Policy. We handle all data in compliance with applicable privacy laws, including the GDPR and CCPA, and may retain anonymized records for benchmarking or feature improvement purposes.

9. No Warranties

The Service is provided "as is" without warranties of any kind, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that your use of the Service will result in specific business outcomes or performance gains.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to lost profits, loss of data, or business interruption.

11. Modifications to Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email or in-app notification. Continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
